Rahul Gandhi was found guilty of criminal defamation by the Surat Court for his alleged remark about the “Modi surname”.

A SURAT DISTRICT COURT ruled Thursday that Congress Leader Rahul Gandhi was guilty of criminal defamation for his alleged statement about the ‘Modi surname’.

Despite being granted bail, the former Congress President was sentenced to two years in prison.

The court of Chief Judicial Magistrate HH Varma, which found Gandhi guilty under sections 499 and 500 of the Indian Criminal Code, also postponed his sentence for 30 days to allow him to appeal to a higher court.

Purnesh Modi, a BJP Leader and former Gujarat minister, filed the complaint in response to Rahul Gandhi’s claimed statements during a rally in Karnataka’s Kolar in 2019 before the general elections, in which he reportedly remarked, “How come all the thieves have Modi as the common surname?”

This happened after the court of Chief Judicial Magistrate HH Varma finished hearing closing arguments from both parties last week and was due to rule today in the four-year-old instance of defamation. As the judgment was read aloud in court, Rahul Gandhi was there.

Immediately after the court’s judgment, a BJP Legislator who had filed a suit against Rahul Gandhi for his “Modi surname” comment applauded the decision.

State Congress officials, including GPCC president Jagdish Thakor, parliamentary Party Leader Amit Chavda, senior Leader Arjun Modhwadia, and AICC in-charge of Gujarat Raghu Sharma, had arrived at Surat airport earlier in the day to greet Gandhi.

Many Party workers had gathered in various parts of the city to show their strength and support for Gandhi, with banners hailing him as the “hero of Hindustan” and placards saying that the “Congress would not kneel before the dictatorship of the BJP” on display.

Purnesh Modi, a legislator from India’s ruling Bharatiya Janata Party, took action after claiming that Mr. Gandhi’s words had defamed the whole Modi community.

Mr. Gandhi’s counsel claimed that the proper legal processes were not followed. They further claimed that Narendra Modi should have filed the complaint because Purnesh Modi was not the intended recipient of Mr. Gandhi’s speech.

According to the Congress Party, Mr. Gandhi will submit an appeal, and “we will fight and win.”

Mr. Gandhi has yet to make a public statement. However, he has tweeted a Mahatma Gandhi quotation in Hindi: “My faith is founded on the principles of truth and nonviolence. Truth is my God, and nonviolence is how I get it.”
