After being taken to a nearby intensive care unit, the teenager was given a breathing tube. A chemical examination of the fluid taken from a saline bag that was used during his surgery indicated the presence of epinephrine, bupicavaine, and lidocaine. Epinephrine is a stimulant that may have been responsible for the symptoms that the patient was experiencing.
The allegations in the complaint state that workers at the surgical facility came to the conclusion that the instances involving M.K. and J.A. reflected a pattern of purposeful adulteration of IV bags that were utilized at the surgical center. They discovered approximately ten more unexpected cardiac emergencies that happened during apparently ordinary surgery during the months of May and August 2022. The complaint says that this is an unusually high rate of problems for such a short period of time. In each of those instances – which investigators believe took place on or around May 26 and 27; June 27; July 7, 15 and 18; and August 1, 4, 9 and 19 – the only way that medical personnel were able to stabilize the patient was by resorting to emergency measures. These included things like CPR, defibrillation, and chest compressions. The vast majority of the events took place during longer operations that required the use of more than one IV bag, including one or more bags that were retrieved in the middle of the operation from a stainless steel bag warmer.
According to the allegations made in the complaint, none of the cardiac incidents took place during Dr. Ortiz’s surgical procedures, and they started just two days after Dr. Ortiz was notified of a disciplinary inquiry stemming from an incident in which he allegedly “deviated from the standard of care” during an anesthesia procedure when a patient experienced a medical emergency.
