Elon Musk’s Department of Government Efficiency (DOGE) has encountered a major obstacle after a federal judge denied its access to sensitive records from the U.S.
Treasury Department. This ruling comes in response to a lawsuit initiated by 19 state attorneys general against the Trump administration, claiming that DOGE’s access breached federal law.

The lawsuit argued that allowing DOGE, which is not an official government entity, to access these records posed significant security threats and could jeopardize crucial payments such as Social Security and veterans’ benefits. Judge Paul Engelmayer determined that permitting such access could lead to “irreparable harm” due to the risk of data breaches and heightened susceptibility to cyberattacks.
Musk created DOGE with the intention of cutting government expenses, but critics contend that it lacks the necessary authority and endangers sensitive financial data. The judge has mandated that Musk’s team promptly delete any records they downloaded.
This situation raises important questions about privacy and the separation of powers within government functions. As tensions escalate, both President Trump and Treasury Secretary Scott Bessent have been ordered to provide responses by February 14 in the ongoing court proceedings.
In the meantime, Democratic lawmakers are urging investigations into DOGE’s operations, expressing concerns that it could disrupt federally sanctioned payments for vital services like healthcare and childcare. Labor unions have also filed lawsuits challenging the legality of DOGE’s actions within the Treasury Department.
