Maya Hernandez Sentenced 15 Years After Toddler Hot Car Death
  • The one year old boy died after his mother left him in a 101 degree car for over two hours while she received cosmetic injections.
  • The vehicle’s automatic shut off feature disabled the air conditioning after one hour leaving the children trapped in lethal heat.
  • Maya Hernandez pleaded no contest to involuntary manslaughter in exchange for dropping a first degree murder charge.
  • The child’s father and grandmother both stated publicly that the 15 year prison sentence does not feel like sufficient justice.

The Bakersfield sun scorched at 101 degrees that June afternoon. Inside a parked Toyota, one year old Amillio Gutierrez took his last breath while his mother sat in a nearby spa. The cosmetic procedure she sought cost her son his life.

Twenty year old Maya Hernandez now faces the consequences of that devastating choice. A Kern County judge handed down a 15 year prison sentence on March 5, closing a case that left a family shattered and a city in mourning.

What Happened to Amillio Gutierrez in the Hot Car

On June 29, 2025, Hernandez drove from Visalia to a Bakersfield med spa for lip filler injections. She left her two sons, one year old Amillio and his two year old brother, strapped in their car seats with the engine running and AC set to 60 degrees.

The vehicle had a fatal flaw Hernandez overlooked. Its hybrid engine automatically shut off after one hour of idling, cutting the air conditioning as outside temperatures climbed. When she returned two and a half hours later, Amillio was foaming at the mouth and seizing with a body temperature of 107.2 degrees. He died at the hospital.

Maya Hernandez Pleads No Contest in Toddler Death Case

The legal journey reached its critical turning point in February 2026. Facing a potential murder conviction after a December mistrial on that charge, Hernandez accepted a plea deal.

She pleaded no contest to involuntary manslaughter plus two enhancements for great bodily harm to a child under five. Prosecutors dropped the first degree murder count, acknowledging the previous jury had been split toward not guilty on that charge.

Judge Sentences Maya Hernandez to 15 Years: Key Details

Superior Court Judge Charles Brehmer delivered the sentence on March 5 as promised. The 15 year term reflects the plea agreement reached weeks earlier, with Hernandez receiving two strikes on her record.

She has already accumulated more than 280 days of credit from time served during the trial process. The sentence resolves both the involuntary manslaughter charge and the two child endangerment counts from the original December verdict.

Amillio Gutierrez Father Breaks Down Over Maya Hernandez Sentence

Rosendo Gutierrez learned of his son’s death while incarcerated on unrelated charges. Now released, he attended sentencing and spoke raw truth about the pain.

“I just don’t think 15 years is enough,” he said, fearing early release programs could reduce the time. “I think I let them down cause I wasn’t there to save them,” he added with tears. Amillio’s grandmother Katie Martinez echoed the sentiment, reminding the court they will miss a lifetime of birthdays and simple meals with the boy.
